Công văn 398/CCPT-ATTP ngày 06/03/2024 Hướng dẫn của Tổng vụ Sức khỏe và An toàn thực phẩm (DG SANTE) về nguyên liệu nhập khẩu để chế biến xuất khẩu vào EU

Trên cơ sở kiến nghị của Cục Chất lượng, Chế biến và Phát triển thị trường với Tổng vụ Sức khỏe và An toàn thực phẩm (DG SANTE) tại công văn số 195/CCPT-ATTP ngày 29/01/2024 về nội dung chứng nhận kèm theo lô hàng thủy sản xuất khẩu vào Việt Nam để chế biến, xuất khẩu vào EU. Ngày 01/03/2024, DG SANTE đã có công thư số Ref.Ares(2024)1600887 hướng dẫn cụ thể các nội dung liên quan đến yêu cầu chứng nhận đối với lô hàng thuỷ sản nhập khẩu, chế biến tại Việt Nam và xuất khẩu vào EU (Chi tiết văn bản của DG SANTE gửi kèm).

Cục Chất lượng, Chế biến và Phát triển thị trường yêu cầu các Trung tâm chất lượng nông lâm thủy sản vùng:

1. Phổ biến nội dung yêu cầu của cơ quan thẩm quyền EU đến các doanh nghiệp chế biến, xuất khẩu thủy sản vào EU thuộc địa bàn để nghiên cứu và tổ chức thực hiện theo đúng quy định và các nội dung yêu cầu của Chương trình kiểm soát ATTP thuỷ sản và sản phẩm thuỷ sản dùng làm thực phẩm xuất khẩu vào EU ban hành kèm theo Quyết định số 5523/QĐ-BNN-CCPT ngày 21/12/2023 của Bộ NN và PTNT.

2. Chủ động phổ biến đến kiểm tra viên, nhân viên chứng nhận về nội dung hướng dẫn nêu trên; thiết lập phương thức quản lý phù hợp để thẩm tra các nội dung thông tin chứng nhận trong Giấy chứng thư/Cam kết của thuyền trưởng kèm theo lô nguyên nhập khẩu để chế biến xuất khẩu vào EU đáp ứng yêu cầu của EU trong quá trình thẩm định, chứng nhận của đơn vị.

Yêu cầu các đơn vị, doanh nghiệp lưu ý thực hiện./.

Dear Dr Nguyen Nhu Tiep,

Thank you very much for you letter dated 29 January 2024 (your ref.: 195/CCPT-ATTP) in which you raise questions concerning the certification of imported raw materials into Viet Nam for further processing into fishery products to be exported to the EU.

Your first query concerns the use of official certificates attesting the compliance of imported fishery products into Viet Nam with the relevant EU requirements. You propose the possibility that those products are accompanied by a certificate with limited attestations not covering all the relevant EU requirements. I regret to inform you that this proposal does not provide sufficient guarantees of compliance with the relevant requirements. I would like to highlight that an EU listed establishment in a third country might legitimately produce, for non-EU export, fishery products that do not comply with the EU requirements. Therefore, limiting the attestations in the certificate as you suggest, a) does not ensure that the imported raw materials covered by such a simplified health certificate comply with all the EU requirements and, b) it does not enable the certifying officer to avail of the necessary information in order to reliably endorse all the attestations contained in the model certificate FISH-CRUST-HC of chapter 28 of Annex III to Regulation (EU) 2020/2235.

Your second query concerns the use of certificates for fishery products landed in Viet Nam, signed by the captain, in accordance with the model FISH/MOL-CAP of Chapter 30 of Annex III to Regulation (EU) 2020/2235. I confirm that such certificate signed by the captain is sufficient in order to attest EU eligibility of those raw materials directly landed in Viet Nam. If required, your services may take due diligence steps to confirm that the certificate provided by the captain is in conformity with the rules on official certification as required by the Union legislation. We cannot comment further on the document that you provided.
